I could only think his argument is along the lines of not being guilty of any crime and wrongfully accused etc, thus he should not be in prison and therefore isn't guilty of escape as he is free leave.

I liked the whole fiasco with this chap.
Much was made of the terrorist soldier spy who broke out of prison perhaps with the help of Iran and he could be out the country.
He was actually a young man with mental health issues who had planted fake bombs around his base and got out of prison using bed sheets tied under a lorry.
