Not quite. A point would have put them on 37, one point behind Spurs. So if Spurs drew with Chelsea, then West Ham would still be able to overtake them if they beat Leeds and Spurs lost to Everton the last day.
Now, if Spurs get one point from two games, they are ok as their GD is 13 better.
