    I think we are good for getting 10 points more than Luton, because they really are a fucking terrible team who are simply having a good go and it won't last. I'm more concerned about Everton catching us, particularly if they have any success if appealing their 10 point deduction and whatever else they get is no worse than what we get.

    Anyway, we were in breach during the summer in the same transfer window. We will be fine. (gulp)...

    So Everton's points deduction was announced on 17th November. They had two weeks to appeal, which they did (beginning of December), the appeal was heard in the week of 31st January and they still haven't heard the result three months after the initial announcement.

    We still haven't, as far as we know, had a date for the initial hearing but that is supposed to be early April, with the announcement by 12th April. If we have points deducted, it's safe to assume we'll appeal (7 days for that) and then there has to be final decision by 24th May.

    So the appeal process that's taken about three months for Everton on their first charge is going to be fully wrapped in about a month for both us and Everton? Really?

    The longer we go without an announcement on Everton's first case, the more likely I make it that they are trying to find a way to back out of the entire mess with the least loss of face and forget about any points deductions.

    Aren't they different processes? Everton's current deduction predates the new expedited process that we and Everton are going through now.

    I believe this is correct .... but I don't think it disagrees with Simon's general point that he thinks they're trying to find a way out of it all (especially given the rules are going to change again in the summer ffs).

    When I saw a post in this thread I presumed there had been a statement about Everton's appeal. It's due today/any day.

    I'm sure there's no danger of us kicking off legally at Everton's appeal taking 3 months while ours is "expedited" in a month.

    No they don't, look at the table. (deduction is the cnut tax), Poo-ton also beat them at Goodison. I know which team I would rather watch next season and they aren't in Blue. FACT!

    Anyway, the PL moved the goal posts on us by announcing that we couldn't write off promotion bonuses whilst others could and did. Seems shady to me.

    Where do you hear that, as it's literally the first time I've heard that said and I don't believe it is true.

    Everything I have read says those promotion triggered payments are disallowed.

    The promotion bonuses bit is from this Percy article: www.telegraph.co.uk/football/2024/01/02/nottingham-forest-premier-league-spending-breach-risk/

    “Promotion to the Premier League will always create challenges, and the treatment of promotion bonuses is just one such example.

    “The club approaches all such challenges with its long-term financial sustainability firmly in mind, as the Premier League rules intended.”

    I'm not reading that as bonuses not allowable deductions and the premier league moving the goalposts.

    Neither am I. I'm reading it as Forest pushing the limits of what can reasonably be counted as a promotion bonus (something like trying classify all win bonuses in the promotion season?)
