    P.S. allowable losses are circa £5 million a year. Then there is an allowable figure that stretches to a very substantial amount, for which owners are mandated certain behavior. Failure to meet these requirements, or to exceed the threshold at which restorative action is allowed, mandates action at the governance level.

    We, and Everton if it is indeed so, have not marginally overspent. We have massively overspent beyond the limits that restorative action is allowed under the rules.

    I can construct a dumb hypothetical whereby it is quite clear that the spending that caused a breach is quite clearly not in the third year of the relevant period and, thus, would make it silly for clubs to sue over what happened in year three when clubs could not sue over what happened in year 1 or 2.

    There is a fixed point of reference when you look back over the three years to determine whether there has been a breach. Obviously. But, as Forest’s situation here makes very clear, it is the three years that matter. That is why our allowable losses are lower than other clubs, because two of our years were outside of the prem. We may have lost less money last year than the three that went down.

    I’ve no issue with us being in breach, even if I have an issue with the rules being so loaded against a club in the position we were in. Unless the authorities led us on about the Johnson situation, I have no issue with that income not counting even though I have an issue with rules that don’t align with transfer windows. And, of course, an issue with rules that incentivising selling academy players.

    So the rules is the rules and the date upon which you review and apply them is what it is. But when it comes to other clubs saying ‘we got relegated cos they breached the rules’ I disagree that only those who feel they were impacted in the final year of the three having a case. Even ignoring the idea of looking back… the fact that we could have sold BJ two weeks earlier and been compliant shows how daft it is to think that last years’ relegated clubs have anything particular to complain about.

    Totally irrelevant. Whatever the feelz and hot takes, you only are in breach of the rules for the period in which you are actually in breach of the rules. If you have not broken any rules, there is nothing actionable.

    In the period where you do, there is.

    That's it. That's how rules work.

    Of course clubs could go to the courts (if the competition rules don't prohibit it - I don't know, I've only seen the handbook for the period, not the full legals) to argue differently and they may succeed, but the overwhelming likelihood is that it would be an extremely expensive waste of time.

    It's interesting to note the recording of the premier league commission into the recent judgement that docked everton 10 points.

    You might argue that they didn't achieve the stated objective. That might potentially be actionable. It might also lead to an increased punishment to achieve those objectives next time out.

    We've got two weeks to respond, hearings completed by 5th April, decision that we are completely vindicated on 12th, 7 days to appeal, appeal concluded by 24th May.
