Can we be certain that Brennan doesn't have a release clause? Was widely reported that failure to agree on a figure was the reason he didn't sign in the winter of 21/22. £40m seems plausible for what they'd have agreed on last summer when he did sign.
Unlikely he'd go to West Ham or, especially, Everton anyway.
I think that's the key point - he doesn't get the 40M, so even if there was a release clause at that value you have to question whether Brennan would look at either of those clubs and think it's a good career move.
Speaking of release clauses, it looks like Liverpool got MacAllister for 35M in the end. Ouch.
